Domestic and family violence and fines

If you are a victim-survivor of domestic and family violence (DFV) and have received an enforcement order for offences that you weren’t responsible for, you may be able to apply to have the fines withdrawn. This only applies to enforcement orders from the State Penalties Enforcement Registry (SPER) for certain camera-detected infringement or tolling offences.

Camera-detected infringement notices must have been issued by:

  • Department of Transport and Main Roads
  • Queensland Revenue Office
  • Road Safety Camera Office.

Who can apply

You can apply to have certain fines withdrawn if you meet the following conditions:

  • You are a victim-survivor of DFV.
  • You have fines that have been registered with SPER that are a
    • camera-detected infringement issued by one of the agencies listed above

    or

    • tolling offence.
  • You were not responsible for the offending behaviour.
  • The perpetrator of DFV committed the offence for which the infringement was issued.
  • DFV has prevented your ability to
    • nominate the driver that committed the offence in the car that is registered to you

    or

    • reject a nomination for an infringement that was not incurred by you.

Fines not eligible

The following fines cannot be withdrawn:

  • court-imposed fines
  • fines issued to a corporation
  • fines issued by a council, university or another authority (i.e. not issued by one of the agencies listed above)
  • fines issued in person (e.g. a traffic infringement notice issued to the applicant in person by a police officer).

How to apply

To apply, you (or someone authorised to act for you) can:

To nominate someone else to act or apply on your behalf—such as an authorised professional, friend or family member—log in to SPER Online, click Manage account and select the Authority to act option.

Alternatively, you can download an authority to act form. An authorised professional can provide SPER with a copy of an authority to act form they have already established with the applicant.

If possible, list the SPER debt ID numbers or infringement numbers or the period during which the eligible fines were incurred and include supporting documents, such as:

  • domestic violence order
  • temporary protection order
  • police report about DFV
  • support letter or report from an authorised professional.

Send the completed application form and supporting documents by email or post.

What happens next

We will let you know once we receive your completed application.

Your fines will be put on hold and you'll be informed of our decision.

If your application is successful, the eligible fines will be withdrawn.
